Agreement to terms

By accessing the Nudge website or downloading, installing, or using the Nudge mobile applications (Android or iOS), you agree to be bound by these Terms and Conditions. If you do not agree, do not use our services.

Description of services

Nudge provides end‑to‑end encrypted messaging and calling services. The website offers information, downloads, and related content. The mobile applications enable secure communication. We reserve the right to modify, suspend, or discontinue any part of our services with reasonable notice where practicable.

Mobile applications

The Nudge applications are available for Android and iOS. The following terms apply in addition to these general Terms and Conditions.

Acceptable use

You agree to use Nudge only for lawful, authorized, and acceptable purposes. You will not use (or assist others in using) our services in ways that:

• Violate or infringe the rights of NeedleTails, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights.
• Involve sending illegal or impermissible communications, including spam, unsolicited bulk or automated messaging, scams, or harassment.
• Harm Nudge, our infrastructure, or other users—for example by attempting unauthorized access, disrupting service integrity, creating accounts through unauthorized or automated means, or collecting information about users without authorization.
• Circumvent security, encryption, or access controls, or use Nudge to distribute malware or other harmful code.
• Misrepresent your identity, impersonate others, or use the service for fraud or illegal activity.

We may investigate reports and other signals of abuse. Violations may result in suspension or termination as described below.

Your account and our policies

You must use Nudge according to these Terms and any policies we publish. You are responsible for keeping your devices and account secure. Because Nudge is end-to-end encrypted, we cannot access the content of your messages or calls. If we disable your account for a violation of these Terms, you will not create another account or attempt to regain access without our permission.

Spam and safety reports

Nudge provides in-app tools to report spam or abusive accounts. When you submit a report:

• You are not required to include a written comment in the report flow.
• Reports may include account identifiers, device metadata, and related technical information needed to investigate abuse on our servers.
• Reported message contents are not uploaded—private messages and calls remain end-to-end encrypted and are not readable by NeedleTails.

Submitting a report does not guarantee any particular enforcement outcome. We review reports and may take action when we determine a violation of these Terms.

Suspension and termination

We may modify, suspend, or terminate your access to Nudge—or any part of our services—at any time, with or without notice, if you violate the letter or spirit of these Terms, if you create harm, risk, or possible legal exposure for NeedleTails or other users, or for any other reason permitted by law. Provisions that by their nature should survive (including disclaimers, limitations of liability, and dispute terms) will survive termination of your use of Nudge.

Intellectual property

Nudge, the Nudge logo, and related marks are owned by NeedleTails or its licensors. You may not copy, modify, distribute, or create derivative works without our written consent. The software is provided under the applicable license terms.

Disclaimers and limitation of liability

Nudge is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error‑free service. To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, or consequential damages. Our total liability is limited to the amount you paid for our services in the twelve months preceding the claim, or one hundred dollars (USD), whichever is less. Some jurisdictions do not allow these limitations; in such cases, our liability is limited to the maximum permitted by law.

Modifications

We may update these Terms from time to time. We will post the revised terms on this page and update the "last updated" date. Continued use of our services after changes constitutes acceptance. We encourage you to review these terms periodically.
